2. Applicability

These Terms and Conditions apply to all offers, agreements, and transactions between Futuri and its customers.

By placing an order or using our services, you agree to these Terms.

If any provision is invalid, the remaining provisions remain in full force.

3. Products and Services

Futuri offers:

  • Physical products
  • Digital products (such as downloads, software, or online content)
  • Related services

Product descriptions are provided as accurately as possible.

4. Offers and Agreements

All offers are non-binding unless explicitly stated otherwise.

An agreement is concluded when:

  • you place an order, and
  • we confirm it (or begin processing it)

We reserve the right to refuse or cancel orders in justified cases.

5. Prices and Payment

All prices are in euros (€) and include VAT unless stated otherwise.

Payment must be made via the available payment methods at checkout.

If payment fails or is not completed, we may suspend or cancel the order.

6. Delivery of Physical Products

We aim to deliver orders within the indicated timeframe.

Delivery times are estimates and not strict deadlines.

If a product cannot be delivered, we will inform you and offer:

  • a replacement, or
  • a refund

The risk transfers to the customer upon delivery.

7. Digital Products and Services

Digital products are delivered electronically.

By purchasing digital content, you agree that:

  • delivery may start immediately after purchase
  • your right of withdrawal may be waived (see section 9)

You are responsible for having compatible software and systems.

8. Right of Withdrawal (Consumers Only)

Physical Products

Consumers have the right to withdraw from a purchase within 14 days of receiving the product, without giving a reason.

After withdrawal, you have an additional 14 days to return the product.

Conditions:

  • The product must be unused and and the in original packaging
  • Return shipping costs are borne by the customer unless stated otherwise

Refunds will be processed within 14 days after receiving the returned product.

Digital Products

The right of withdrawal does not apply if:

  • the digital product has been delivered, and
  • you have explicitly agreed to immediate delivery, and
  • you acknowledged losing your right of withdrawal

9. Exceptions to Withdrawal

The right of withdrawal does not apply to:

  • Custom or personalized products
  • Sealed products that are not suitable for return due to hygiene reasons once opened
  • Digital content delivered immediately with consent

10. Obligations of the Customer

You agree to:

  • Provide accurate information
  • Use products and services lawfully
  • Not misuse or attempt to disrupt our systems

11. Liability

We are liable only for direct damages resulting from our breach of obligations.

We are not liable for:

  • indirect or consequential damages
  • loss of profit or revenue

Our total liability is limited to the amount paid for the relevant product or service, unless otherwise required by law.

Nothing in these Terms excludes liability where it cannot be excluded under applicable law.

12. Intellectual Property

All intellectual property rights remain with Futuri or its licensors.

You may not copy, distribute, or commercially use our content without permission.

Digital products are provided for personal use only!

13. Complaints

If you have a complaint, please contact us via email.

We aim to respond within 14 days.

Consumers in the EU may also use the Online Dispute Resolution platform:

14. Termination

We may suspend or terminate agreements if:

  • you violate these Terms
  • payment obligations are not met
  • unlawful use is detected

15. Force Majeure

We are not liable for delays or failure caused by events beyond our control, including:

  • technical failures
  • supply chain disruptions
  • government measures

16. Privacy

We process personal data in accordance with our Privacy Policy.

17. Governing Law and Jurisdiction

These Terms are governed by Dutch law.

Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.

18. Changes to These Terms

We may update these Terms at any time.

The latest version will always be published on our website.

Continued use of our services implies acceptance of the updated Terms.
